PART B: ADDITIONAL TERMS FOR BUYERS (E-COMMERCE & SALES)

This section applies additionally to any user who places an order or purchases goods directly through our online platform.

 

5. Account Registration

  • To make a purchase, you may be required to register for an account. You are solely responsible for protecting your password and login credentials. You must provide current, accurate billing and shipping information.

 

6. Contract Formation & Pricing

  • Order Acceptance: Your order represents an offer to purchase, which is only accepted by us when we send you a dispatch confirmation or processing notice. We reserve the right to cancel or reject any order at our discretion (e.g., due to an obvious pricing error, technical glitch, or stock issue).

  • Pricing & GST: All prices are listed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless explicitly stated otherwise.

 

7. Food Handling, Storage & Safety

  • Perishable Products: Many of our products (including frozen dough packs, bases, and cheeses) are perishable and snap-frozen.

  • Buyer Duty of Care: It is your strict responsibility to ensure someone is available to receive delivery of perishable items, and to transfer them to a freezer or refrigerator immediately upon arrival or within a timeframe that ensures the product doesn't spoil. Sugo tu Pty Ltd accepts no liability for spoilage, defrosting, or contamination occurring after the delivery package has been dropped off at your designated shipping location.

 

8. Shipping and Delivery

  • Delivery zones, timeframes, and shipping costs are detailed dynamically at checkout.

  • While we make every effort to meet stated shipping times, delays caused by third-party courier services are beyond our control, and time is not of the essence for delivery.

 

9. Refunds, Returns, and Consumer Guarantees

  • Australian Consumer Law (ACL): Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of quality.

  • Perishable Exceptions: Due to health, safety, and food standards compliance (HACCP/SQF), we cannot accept returns or provide refunds for change-of-mind purchases or improper home storage.

  • Reporting Issues: If a product arrives damaged or defective, you must contact us within 24 hours of delivery at homedelivery@sugotu.com.au with photographic evidence.
